Privacy Policy
Ballast Planning LLC Effective 29 July 2026 · Version 1.0
The short version
We collect very little. The free standing check saves nothing unless you ask us to email you the result. We do not sell personal information and we do not run advertising. We do not knowingly collect information from anyone under 18.
1. Who we are
Ballast Planning LLC, a Utah limited liability company. Contact: info@ballastplanning.com.
2. What we collect
Information you give us
| What | When |
|---|---|
| Association details you enter into the standing check (unit counts, budget figures, study dates, and similar) | When you run the check |
| Email address, and optionally your name and association name | When you ask us to email a result, request a study review, or contact us |
| Reserve studies, budgets, and other documents | When you submit them for a study review or an engagement |
| Billing information | When you purchase a paid service |
Information collected automatically
Standard server and request data: IP address, browser type, pages viewed, timestamps, referring page, and privacy-preserving analytics about how the site is used.
We do not collect Social Security numbers, government identifiers, or financial account numbers through this site. Do not send them to us.
3. What the standing check saves
Running the free check saves nothing that identifies you. The check computes and displays a result. No record is written.
We record an anonymous event that a check was run, so we can count usage. It does not contain your inputs or anything identifying.
A record is created only when you attach yourself to it, by asking us to email the result, submitting a study review, or entering a paid engagement. At that point we store your inputs, the result, and the rule set used, because a determination has to be reproducible later.
4. Why we use it
- To provide the check, the study review, and paid services
- To send a result you asked for, and to respond to you
- To keep a durable record of any determination we issue
- To operate, secure, and improve the site
- To send you updates only if you asked for them; every email has an unsubscribe link
- To meet legal, tax, and insurance obligations
We do not sell personal information. We do not share it with advertisers. We do not run behavioral advertising.
5. Automated processing
We use software and automated systems, including artificial intelligence, to produce our tools and deliverables. Paid deliverables are reviewed by a person before they are issued. No decision that produces a legal or similarly significant effect about you is made by automated processing alone: the standing check returns an informational screening result, not a decision about you, and it is not a determination of anyone's eligibility for credit.
6. Who we share it with
Service providers, under contract, only to run the business: hosting and delivery, database and storage, payment processing, email delivery, and error monitoring. They may process information only on our instructions.
Your management firm, where it engaged us on your association's behalf or where you asked us to route work through it.
Professional advisers and insurers, where reasonably necessary, including in connection with an insurance claim or a security incident.
Legal, where required by law, subpoena, or court order, or to protect rights and safety.
Business transfer, if the business or its assets are acquired. We will give notice.
7. Anonymized and aggregated data
We produce statistics that do not identify you or your association: for example, how often a criterion fails across all checks. We may publish this. It is not personal information and it cannot be traced back to you or your property.
8. How long we keep it
| Category | Retention |
|---|---|
| Anonymous usage events | 24 months, then deleted |
| Lead and contact records | While the relationship is active, plus 3 years after last contact |
| Determinations and reports | Retained indefinitely: a determination must render years later exactly as issued |
| Client documents and study submissions | Term of engagement plus 7 years |
| Billing records | 7 years |
9. Your choices
You may ask us to access, correct, delete, or export your personal information, or to stop marketing email. Write to info@ballastplanning.com and we will respond within the time the law requires.
One limit, stated plainly: we cannot delete an issued determination or the inputs behind it. A determination is a dated record that must remain reproducible. We can remove your contact details from marketing, close your account, and stop further processing, but the determination record stays.
Depending on where you live you may have rights under the Utah Consumer Privacy Act, the California Consumer Privacy Act, or a similar state law, including rights to know, delete, correct, and opt out of sale or targeted advertising. We do not sell personal information or use it for targeted advertising, so there is nothing to opt out of. We will not discriminate against you for exercising a right.
10. Cookies
The site currently sets no cookies. If we add any, they will be limited to those strictly necessary to make the site work and keep it secure. We will never use advertising or tracking cookies, and we will update this policy when anything changes. You can block cookies in your browser.
11. Security
We use encryption in transit, access controls, and row-level database security, and we limit who can reach client data. No system is perfectly secure, and we cannot guarantee absolute security. If a security incident affects your personal information, we will investigate it and notify you and any regulator as the law requires.
12. Children
The site is for adults acting for community associations and their advisers. We do not knowingly collect information from anyone under 18. If we learn that we have, we will delete it.
13. Where information is processed
Information is processed in the United States. If you are outside the United States, do not submit personal information through this site.
14. Disputes
Section 15 of our Terms of Use governs disputes relating to this policy, including its arbitration agreement, class action waiver, and thirty-day opt-out. Utah law governs.
15. Changes
We may update this policy. The version and effective date appear at the top, and material changes will be noted on the site.
